Welcome to Adthlete! These Terms of Service ("Terms") govern your use of the Adthlete platform and services as a user ("you," "your," or "Athlete"). By signing up or using our platform, you agree to be bound by these Terms.
1. Eligibility
To use Adthlete, you must be at least 18 years old or have reached the age of majority in your jurisdiction, and be a current or recent student-athlete authorized to monetize your name, image, and likeness (NIL) in compliance with NCAA, NAIA, or other applicable rules.
2. Account Registration
You must create an account and provide accurate, up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
3. Services Provided
Adthlete sends you advertising opportunities and facilitates monetizing content you’re already posting authentically. We offer tools to help you add accepted advertising campaigns into your content for ad revenue share.
4. NIL Rights and Usage
By using the platform, you grant Adthlete a limited, non-exclusive, royalty-free license to use your name, image, likeness, and submitted content solely for the purpose of facilitating advertising opportunities.
5. Payment Terms
Adthlete invoices brands on your behalf. Brands have net 30 payment terms. Once Adthlete receives funds, you will be paid within 5 business days. Payouts are subject to providing W-9 for tax purposes.
6. Compliance
You agree to comply with all relevant NIL laws and institutional policies. Adthlete is not liable for any violation of NCAA, NAIA, state, or school-level rules resulting from your actions.
7. Termination
We may suspend or terminate your account for breach of these Terms, unlawful activity, or inactivity. You may also delete your account at any time.
8. Dispute Resolution
These Terms are governed by the laws of the State of Texas. Any disputes will be resolved through binding arbitration or in courts located in Dallas County.
9. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes and your continued use of the platform signifies your acceptance.
